Article 255 of the Treaty establishing the European Community, as amended by the Treaty of Amsterdam, states that "Any citizen of the Union, and any natural or legal person residing or having its registered office in a Member State, shall have a right of access to European Parliament, Council and Commission documents".
Article 15(3) of the consolidated version of the Treaty on the Functioning of the European Union provides for a right of access to documents of the Union's institutions, bodies, offices, and agencies. The same right is recognised in Article 42 of the Charter of Fundamental Rights of the EU.
Regulation (EC) No 1049/2001 of the European Parliament and the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents (OJ L 145 of 31.5.2001, p. 43) governs this fundamental right of access to documents.
In line with Article 23 (1) of Regulation (EC) No 58/2003 laying down the statute for executive agencies to be entrusted with certain tasks in the management of Community programmes, the Agency adopted on 30 September 2008 detailed rules for the implementation of Regulation (EC) No 1049/2001 (Decision SC(2008)001).
Requests for access to documents may be submitted in any EU official language. However, in order to facilitate the processing of your request, you are kindly invited to submit your request in English or French.
Please note that some documents may be covered, in whole or in part, by the exceptions to public access defined in Regulation 1049/2001. In some cases, a general presumption of non-accessibility has been recognised by the EU Courts and may be used by the Commission to refuse access, in particular for documents forming part of the following procedures: pending court cases, bids submitted by tenderers, OLAF investigations.
