Access to documents

Public access to the EC register of documents is available. If the document you are looking for is not listed there, on Key documents or on any other section of the Agency's website, you may enter a request for access to a document.

If the document you are looking for is not present in any section of the Agency's website, you may enter a request for access to a document.

If your request does not concern programmes managed by the Agency, please use the European Commission’s access to documents form.

Legal basis

Article 15(3) of the consolidated version of the Treaty on the Functioning of the European Union (TFEU) provides for a right of access to documents of the Union's institutions, bodies, offices, and agencies. The same right is recognised in Article 42 of the Charter of Fundamental Rights of the EU.

Regulation (EC) No 1049/2001 of the European Parliament and the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents  governs this fundamental right of access to documents.

In line with Article 23 (1) of Regulation (EC) No 58/2003 laying down the statute for executive agencies to be entrusted with certain tasks in the management of Community programmes, the Agency adopted on 30 September 2008 detailed rules for the implementation of Regulation (EC) No 1049/2001 (Decision SC(2008)001).

Procedure

Any EU citizen and any natural or legal person residing or having its registered office in the EU, has a right of access to the documents held by Agency, subject to the conditions defined in Regulation 1049/2001.

Please note that some documents may be covered, in whole or in part, by the exceptions to public access defined in Regulation 1049/2001. In some cases, a general presumption of non-accessibility has been recognised by the EU Courts and may be used by the Agency to refuse access, in particular for documents forming part of the following procedures: pending court cases, bids submitted by tenderers, grant proposals submitted by other candidates, OLAF investigations.

Requests for access to documents may be submitted in any EU official language. However, in order to facilitate the processing of your request, you are kindly invited to submit your request in English or French.

You are kindly requested to provide your contact details as a natural or legal person in the relevant fields of the form. Please also provide a full postal address with your request.

The application must be made in a sufficiently precise manner and must contain, in particular, sufficient elements to enable the Agency to identify the document requested.

We reserve the right to refuse to deal with your request in case of incomplete or incorrect data.

Following your initial request, you have the right to request the Agency to review its position of not granting access, by submitting a confirmatory application under the conditions of Article 7(2) of Regulation 1049/2001.

In case the Agency maintains its position of not granting access, you may, under the conditions of Article 263 TFEU, bring proceedings before the General Court, or, under the conditions of Article 228 TFEU, file a complaint with the European Ombudsman.

All your data is handled in conformity with the provisions and requirements of the data protection Regulation (EU) 2018/1725. You may consult the privacy policy with regard to the processing of personal data related to requests for access to documents.
